There is an ineffable logic to the pace of reform these days. Nowhere is that clearer in both the success of voter reform measures in the United States (along with timelines for implementation baked into the language of the same) and developments internationally. No matter that New Zealand decided to take a recent punt on the issue, there are other forces moving elsewhere that have the potential to be far more consequential – and in the short term.

Israel Announced Its Intent To Create A Recreational Market in 2021

israel flagThere is little news anywhere as consequential as that of the oldest medical market finally succumbing to the inevitable. Namely, Israel has announced that it will allow an adult use market to begin operations probably by the third quarter of 2021. That said, don’t hold anyone to a deadline in the days of COVID-19, which will just as surely have not passed by then.

However, this development means that the entire conversation has moved up a notch – because the Israelis have so much research on the plant at this point.

For this reason, the tiny country is likely to have an outsized impact on the entire discussion – along with conveniently timed medical exports to the world.

Luxembourg Will Initiate Its Recreational Market Shortly Thereafter

It is likely not insignificant that the Israelis announced their intent to begin an adult use market just ahead of the long-announced Luxembourg flip – now on the agenda of the Green Party domestically for several years.

The strategic location of Luxembourg in both the European market as well as the much larger financial one now interested in the vertical cannot be understated. Indeed, the country has already played an outsized role in the development of the medical market here due to the contretemps over the clearing of stock trades in the German market as of 2018.

The double whammy of good news from both markets will also create a buzz internationally that is sure to drive other conversations forward – even if it is to study how both countries approach the issue. And, more to a point, how they differ from Canada, including regulation of their equity markets.

Combined with a more regulated market in Holland and presumably continued “experimentation” in Denmark, and by the end of next year, adult use reform will have hit the continent and in no small way.

Does This Mean The Sudden Potential of Adult Use Everywhere?

As 2020 has shown, in spades, just about anything can and frequently does happen. However, do not expect many more countries to move into the recreational column for the next several years.

Whatever the UN does or does not do about cannabis at the next meeting of the WHO, cannabis the plant remains a Schedule I drug internationally. This means that, for example, import and export of the same across borders, even in Europe, is likely to be problematic and for some time to come – let alone its international travel across say, the Atlantic.

Further from the law enforcement and financial security (namely money laundering) perspective, there are big issues that have to be dealt with finally, internationally, that so far have not – and under the guise of “medical reform.”

For that reason, in other words, do not expect Germany, much less France or even the UK to suddenly switch gears. And remember that both Luxembourg and Israel are small countries.

Bottom line? Adult use reform is here to stay, and will increasingly show up on the map. But the more “blanket” reform, still driving the entire discussion, is broadly, and globally, medical.

Jessica LaPlace is raising three children, working full time and studying for a business degree at the University of the Virgin Islands, and if that’s not enough, the St. Thomas native recently added the title of entrepreneur to the list.

On November 15, the busy wife and mother launched Bloom Altitude 365. The online retail shop offers a wide variety of non-medicinal health and beauty products formulated with CBD and hemp. Categories range from cosmetics and body creams to aromatherapy inhalers, CBD oil drops, edibles and more.

“I chose this type of business because I have a passion for the health field,” LaPlace said. “I wanted to combine my background and experience with my entrepreneurial skills in order to serve my community.”

LaPlace said she personally selected all her products, which are organic and non-GMO, “and every item is tested by friends and family.”

Also a proud veteran, LaPlace served three years in the Navy. During that time her eldest child, Joshua, now 20-years old, was born.

Growing up on St. Thomas, LaPlace took an early interest in health care.

“From the time I was in eighth grade through the 12th grade, I worked in labor and delivery at the hospital,” she said.

LaPlace fondly recalled having been an assistant to head nurse/ midwife Cynthia Stapleton, for whom the Labor and Delivery unit at Schneider Regional Medical Center was later named.

“It was intriguing work,” said LaPlace.”Very fulfilling.”

LaPlace also worked in a physician’s office for a period of time. That lifelong interest in health led to her new venture.

“Years ago, I also started watching programs on the benefits of CBD and hemp,” she said.

One case LaPlace cited was the plight of Charlotte Fiji, who suffered from a rare form of epilepsy. CBD, or cannabidiol, is a type of chemical found in the same plant that produces marijuana.

CBD is different from marijuana though, and will not make you “high.” That’s because it does not contain the main psychoactive compound in cannabis, THC, which is the chemical responsible for the intoxicating feeling associated with consuming marijuana. 

Recently, CBD has gained traction in the scientific community for its ability to treat multiple conditions — from chronic pain to epilepsy. Here are some of the benefits of CBD oil and whether science says it might be helpful for you. 

1. CBD oil eases pain 

CBD has been widely studied as a natural, non-addictive way to manage and treat pain symptoms — especially as an alternative to opioids for patients with severe pain. 

While animal research found CBD to be a promising treatment for nerve-based (neuropathic) pain and inflammatory pain, few studies have examined its effects on humans. 

Still, researchers know that CBD has antinociceptive and anti-hyperalgesic effects — meaning it can block the detection of pain by neurons and counter pain sensitivity. 

“CBD has over 65 different targets in the brain and body, working at many receptors and other areas to change messages that cells are sending to each other. If the message of pain is being sent from one cell to another, CBD can block or diminish this message,” says Bonni Goldstein, MD, the Medical Director of Canna-Centers, a California-based medical practice devoted to patients about the use of cannabis for serious or chronic health conditions. 

Goldstein says that higher ratios of CBD to THC are often more effective for inflammatory pain like rheumatoid arthritis, while lower ratios are more effective for nerve-based pain like shingles

A 2006 study found that combining THC and CBD increased each cannabinoid’s effectiveness in reducing pain and diminished adverse effects of using just THC alone.  

“Studies clearly show that all types of pain respond better to products that contain both compounds rather than each one alone,” Goldstein says. 

2. CBD oil can treat epilepsy 

Epilepsy is a neurological disorder in which abnormal brain activity causes seizures. Recent studies show that CBD may be an effective treatment for epilepsy, although scientists are unsure of the exact mechanisms, Goldstein says. 

A 2017 study of patients ranging from two to 46-years-old with treatment-resistant epilepsy found that 86% of patients experienced a reduction in seizures after consuming various formulations of artisanal CBD, which is CBD that contains small amounts of THC. Of the participants, 10% reported becoming seizure-free.

Another small 2018 study found that children who took a daily 20mg/kg dose of CBD oil saw a significant decrease in seizure frequency compared to a placebo. However, the study did find seizure intensity increased in patients taking CBD. 

3. CBD oil may reduce anxiety 

Early research has found CBD may reduce symptoms of a number of anxiety disorders, including: 

A small 2011 study of patients with social anxiety disorder (SAD) found 600mg of CBD significantly reduced anxiety, cognitive impairment, and discomfort when patients were subjected to a stressful situation like public speaking. 

Goldstein says that CBD affects the brain in multiple ways, including enhancing the brain’s own anxiety-reducing chemicals and targeting serotonin receptors involved in mood. 

“There is preliminary research that points to neuroinflammation as a cause of anxiety. CBD is a well-proven potent anti-inflammatory which may contribute to its anxiety-reducing effects,” Goldstein says. 

Risks of CBD oil 

However, much research on CBD oil is still preliminary, and there are also various health risks to consider before using it. 

It’s unregulated. Unless you’re purchasing CBD with a medical card from a state-licensed store, known as a dispensary, or in a state where marijuana is legalized, you’re forced to navigate an unregulated market that’s potentially filled with “fake” or low-quality CBD. Make sure you check your state’s laws and look for companies who partake in third-party testing before purchasing CBD, says Goldstein.  

It can interact with medications. CBD is broken down in the liver, where many other medications are metabolized. Medications that CBD can interact with include

  • Seizure medications like Brivaracetam or Carbamazepine
  • Chemotherapy drugs like Everolimus 
  • Muscle relaxers like Chlorzoxazone
  • Respiratory medicines like Theophylline
  • High blood pressure medications like Verapamil or Propranolol
  • Antidepressants like Amitriptyline 
  • Antipsychotic medications like Haloperidol or Clozapine

“Anyone with serious medical conditions who take medications should avoid using CBD without medical supervision,” Goldstein says. “Patients on certain medications such as blood thinners or other medications for serious illnesses should always have medical supervision.”

It may be unsafe if you’re pregnant. While there is a lack of research studying the effects of CBD on pregnant women and their children, the FDA recommends that pregnant and breast-feeding women should avoid CBD oil. 

Animal studies have shown that maternal or paternal exposure to CBD and THC can hinder proper fetal development, and unregulated CBD products could be contaminated with substances that could harm fetuses or breastfed babies. 

It can have side effects. CBD is often well-tolerated, but adverse reactions can occur at higher doses. These side effects include: 

  • Diarrhea
  • Sedation
  • Worsening seizures in those with epilepsy 
  • Decreased appetite

How to use CBD oil safely 

In 2018, US Congress passed a bill that regulated the production of hemp, or cannabis with extremely low levels of THC, allowing it to be grown and manufactured into products. But not all states have adjusted their laws, so CBD is still illegal in some states including Idaho, Nebraska, and Iowa.

In states where CBD is legal, you’ll have to be either 18 or 21 to purchase it — and make sure to check local laws before traveling across state lines with it. 

While there are multiple ways to consume CBD, oral consumption appears to be mostly the preferred method. That’s because vaping and smoking can cause damage to the lungs. Additionally, topical application can be difficult to measure the dosage.

Popular methods of consumption include: 

  • Oral consumption (oils, tinctures, pills, edibles)
  • Smoking or vaping 
  • Topical application (creams, lotions, transdermal patches) 
  • Intranasal consumption (sprays) 

CBD has a very wide therapeutic range, with doses ranging from 10 mg per day up to 800 mg per day. “The only way to find one’s dose is to start at a low dose and increase little by little, looking for the dose that gives the best effects,” Goldstein says.

RAGUSA, Italy, Nov. 24, 2020 (GLOBE NEWSWIRE) — Last week, the Court of Justice of the European Union (CJEU) ruled that cannabidiol (CBD) is not a narcotic drug. For companies like Canapar, this is a landmark ruling that could change the face of CBD sales and marketing across Europe.

This announcement opens the door to exciting new opportunities in the European market and enables Canapar to position itself as a leader in both the continental and global CBD industries,” said Sergio Martines, CEO, Canapar. “The CJEU ruling could have positive implications, such as reopening the novel foods authorization process for CBD, that were paused by the European Commission due to the narcotic question.”

The European Union’s highest court ruled on two crucial points for the industry. First, that CBD “does not appear to have any psychotropic effect or any harmful effect on human health” (the Court also noted that CBD in question was extracted from cannabis sativa, grown legally, and with THC content not exceeding 0.2%). Therefore, CBD should not be considered a narcotic drug within the meaning of the United Nations Single Convention on Narcotic Drugs, 1961. Second, the CJEU found that the provision on Free Movement of Goods within the EU (Articles 34 and 36 TFEU) were applicable as CBD is not a “narcotic drug”.

With this ruling, companies can begin safely rolling out made-in-Europe CBD products without fear of having their products banned,” added Olivier Dufourmantelle, Chairman, Canapar.

It’s hard to hold a candle in the cold November rain, unless you’re in the cannabis industry. There’s much to be celebrated in this contact-less Thanksgiving Week in America. You may have missed it amongst the surge of COVID cases, the unprecedented presidential election, and the slew of voter fraud lawsuits that have been filed, but November, 2020, has been tremendous for our industry. Months like this drive me and our law firm’s clients to push forward every day to develop this business on a global basis. 

In the last month, we saw an election night Green Wave — a clean sweep for marijuana reform measures which enact regulatory systems in five U.S states: my home state of New Jersey (which is, after all, the Garden State); Arizona (second time is a charm for an adult use ballot measure; Montana; South Dakota; and even Mississippi. The latter two states are historically very conservative politically, with a previously staunch stand against cannabis reform. Interestingly, President Trump’s own words were used in the pro medical marijuana initiative in Mississippi, highlighted in ads where Trump had previously stated that “[he] think[s] medical should happen, right? Don’t we agree? I mean I think so.” He went on, “I know people that are very, very sick and for whatever reason, the marijuana really helps them.”

Apparently, the tremendous movement forward of cannabis policy reform at the state level has followed Mr. Trump into the White House (when he was elected in November, 2016, we saw a similar Green Wave with eight of nine marijuana reform measures passed across the United States). Must be something about a Trump Presidential election that gets out the cannabis vote.    

We also saw Israel announce an imminent plan to legalize adult-use cannabis, with sales to users aged 21 and up. This is significant considering Israel’s prominent position in the cannabis industry as a science and technology provider. Its domestic policies will now track its international business policies. This is big because Israel is a United Nations Member State with nearly 9 million people in the Middle East. Stay tuned.  

The USDA awarded a grant to the National Industrial Hemp Council (NIHC) for the advancement of U.S. Hemp exports into the international market. This dovetails with the notion that the hemp industry continues to move forward, as I’d detailed in my prior article. It furthers that precise notion by seeking to expand opportunities for hemp fiber, feed, food, and CBD companies looking to break down trade barriers in markets overseas, as promoted by the NIHC.  Our law firm has been doing this for years now as a practical matter, without a government grant.  But we wish the NIHC luck and are happy to support its efforts.  

Biden’s advisors are pushing a new plan to slow global warming: a soil carbon bank for farmers. This one has fallen under the radar for many folks in the cannabis industry, but if you’ve paid attention to the great efforts around the global effort to regenerate agriculture, you’ll understand that this puts industrial hemp front and center. If you haven’t yet, it’s worth your time to watch Kiss The Ground on Netflix, which focuses on “regenerative agriculture” and explores the connection between the soil and climate change, and the many ways we as consumers can use dirt to help heal the earth. Industrial hemp fits nicely within this policy, as the plant rapidly captures carbon dioxide from the atmosphere and makes what we breathe much cleaner. In fact, for every ton of hemp produced, 1.63 tons of carbon is removed from the air. This makes hemp one of the most effective plants on the planet to capture carbon – far more effective than sequestering carbon dioxide from trees. That’s big news for the hemp industry.  

Virginia Governor Ralph Northam announced plans to legalize adult use marijuana. Even Virginia’s Attorney General weighed in, stating that, “Virginia needs to allow legal, regulated adult use of marijuana as a matter of public safety, justice, equity, and economic opportunity…” Needless to say, this represents the continued evolution at the state level of cannabis policy forming a commercial, regulated marketplace. Maybe this will prompt Washington D.C. to reconsider its policy. We now have only six U.S. states where cannabis remains outright illegal. 

On top of all of that, we saw perhaps the biggest day in recent memory for global cannabis policy advancement. As had been long anticipated, Mexico’s Senate approved a landmark cannabis legalization bill by an overwhelming vote. This unequivocally paves the way for the creation of the world’s largest legal marijuana market — if the initiative passes the next hurdle in the lower house of Congress, which it is expected to do. That will highlight the fact that our neighbors to the north and our neighbors to the south have nationally legalized this plant. You don’t think D.C. is paying attention?  

Finally, on November 19th, the Court of Justice for the European Union conclusively determined that A Member State may not prohibit the marketing of cannabidiol (CBD), which is lawfully produced in another E.U. Member State, when it is extracted from the Cannabis sativa plant in its entirety (not solely from its seeds and fiber). This decision dramatically shifts the landscape surrounding CBD (and other non-intoxicating cannabinoids derived from cannabis/hemp) in Europe, which has struggled mightily to outline a coherent policy on industrial hemp-derived cannabinoids. This presents tremendous hope for the continued development of the already-existing, but nascent global cannabis supply chain.

2020 is not all bad. November has been a great reminder of that and given us in the cannabis industry a lot to be grateful for. Time to give thanks.

The Liberty County Chamber of Commerce held a ribbon cutting for Huta Essentials, a CBD shop, on Friday, November 6 at their location, 908 S Main Street Suite 105 in Hinesville.

Chamber & CVB CEO, Leah Poole, welcomed those in attendance and introduced Kathy Villafane, Chairman of the Liberty County Chamber of Commerce. Villafane congratulated the owner, Commissioner Justin Frasier, for opening another establishment and welcomed him as a new member of the Chamber family. Hinesville Councilman Karl Riles also congratulated Frasier and thanked him and his family for continuing to be pillars in the city of Hinesville.

Frasier thanked guests, including his family and close friends, for attending and shared his vision for the CBD shop, “I’m looking forward to not only being a member [of the Chamber], but informing everyone of the great benefits of these products and what they do for people. It’s truly a blessing for me to create another business in my district, and we look forward to doing great things.”
